Terms of Service

The rules for using SMOAC as a client or specialist on our marketplace.

Effective October 22, 2026

Agreement

By creating an account or using SMOAC you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the marketplace.

SMOAC connects clients with independent wellness specialists. SMOAC is a platform—not the provider of training, coaching, medical, or therapy services.

Eligibility

You must be at least 18 years old to create an account or use SMOAC. Creating an account asks you to confirm that. Do not use the product on behalf of someone who cannot legally agree to these Terms.

Accounts

You are responsible for accurate account information and for activity under your login. Keep your password confidential. Specialists are responsible for the accuracy of their listings and for responding to inquiries professionally.

Inquiries and communications

Client inquiries are delivered in the SMOAC portal, with email when a new message arrives and a push on the iPhone app when notifications are allowed. Reply in SMOAC to keep the conversation in one thread. You agree not to misuse inquiry tools (spam, harassment, or unlawful content).

Workout journal and coaching

A client may keep a workout journal with or without a specialist. The journal belongs to the client’s account. It is a training log, not medical advice, and SMOAC does not provide the training.

If you accept a specialist’s coaching invite, that specialist may place workouts on your calendar. They can see whether each workout they sent was started or finished, and the weights and reps logged on those exercises. They cannot see the rest of your journal or your body weight, and they cannot edit a workout you have already started.

You can decline a coaching invite. You agree not to use coaching or the journal to harass someone or to share another person’s private training information.

Marketplace role

Any engagement between a client and a specialist is solely between those parties. SMOAC does not guarantee availability, outcomes, credentials, safety, or response times. We do not perform background checks. Verify specialists independently as needed for your situation.

Specialists listed on SMOAC are independent contractors. They are not employees, agents, or representatives of SMOAC. SMOAC does not supervise their sessions and is not a party to any agreement you make with them.

Listings and media

If you upload photos, videos, or other content, you confirm you have the right to use it. You grant SMOAC a license to host, display, crop, and promote that content on the marketplace (including listings, Boost placements, and related emails) for as long as your listing is active.

Profile videos are a paid membership feature with a short length limit. Do not upload content that is illegal, infringing, or sexually explicit involving minors.

Payments

Browsing and sending inquiries is free for clients. Session rates and packages are set by each specialist. SMOAC does not process those session payments today.

Specialists may purchase SMOAC Pro, SMOAC PRO+, or Boost campaigns. Those charges are billed through Stripe. Membership renews until you cancel. Boost campaigns are prepaid for the days and daily budget you choose. PRO+ includes a Boost discount described in the product at checkout.

Approved specialists may receive a complimentary Pro trial. When the trial ends, the account returns to Free unless you subscribe. Prices shown in the product at checkout control if they differ from marketing copy.

Canceling Pro or PRO+ stops the next renewal. The plan stays active through the period already paid. Boosts are charged up front. If that charge is refunded, the campaign time it bought comes off. Any other refund request goes to support.

Acceptable use

You agree not to:

  • Violate laws or third-party rights.
  • Scrape, reverse engineer, or disrupt the service.
  • Post false, misleading, or infringing profile content.
  • Attempt unauthorized access to accounts or systems.

Disclaimers

SMOAC is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

SMOAC is not a medical, therapy, or training provider. Listings, messages, and the workout journal are not medical advice, diagnosis, or a prescription for exercise. You are responsible for deciding whether an activity is safe for you.

Limitation of liability

To the fullest extent permitted by law, SMOAC and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the marketplace, the workout journal, or interactions with specialists.

To the fullest extent permitted by law, SMOAC’s total liability for any claim relating to the service is limited to the greater of the amount you paid SMOAC in the 12 months before the claim, or one hundred U.S. dollars. This limit does not apply to liability that cannot be limited, including fraud or willful misconduct.

Your responsibility for content

You are responsible for the information you submit, including listings, messages, reviews, and workout content. To the extent allowed by law, you will cover SMOAC against claims and reasonable legal costs arising from that content, from a session you arrange through the marketplace, or from your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts in San Diego County, California, unless a law where you live requires a different venue.

Account closure

You may delete your account in the product, as described in the Privacy Policy. Clients use Edit Profile → Account. Specialists use billing settings and should cancel an active plan first. Email support if you cannot sign in. We may limit access, remove content, or disable accounts when we believe these Terms, our Community Guidelines, or the law have been violated.

Changes

We may update these Terms as the product evolves. Continued use after changes means you accept the updated Terms. The effective date above will change when we publish revisions.
